DOCOMO Communications Laboratories Europe GmbH (“DOCOMO Euro-Labs” or “we”) takes your privacy seriously. Please read the following to learn about our privacy policy, in particular with regard to the General Data Protection Regulation (“GDPR”).

This Website Privacy Policy explains which Personal Data about you is processed through DOCOMO Euro-Labs’ websites accessible at www.docomoeurolabs.de (“Websites”) and how we use your Personal Data. Personal Data is any information relating to an identified or identifiable natural person, for example your name or e-mail address.

Our Websites may contain links to other web pages. This Website Privacy Policy does not apply to such web pages. We recommend that you read the privacy policies of such web sites when you visit them.

4. Purposes and Legal Bases of Data Processing
 
4.1 Provision of the website
When you visit our website, we process your personal data that your internet browser automatically transmits to us:

• Date and time of the retrieval of one of our internet pages
• Type of terminal device
• Browser type
• Browser settings
• IP address
The processing is based on Article 6 (1) f) GDPR. The purpose of the processing is to provide the website, which is also our legitimate interest.

The data is immediately deleted after the provision of the website by the web server.

 
4.2 Server Log Files


When you visit our website, our web server creates a temporary record for each page you request and stores it in a log file based on Article 6 (1) f) GDPR. The following Log File Data is collected:

• IP address and country of the requesting processor
• Date and time of access
• Name and URL (web address) of the visited site
• Name and URL (web address) of the downloaded file
• Volume of data transmitted
• Data identifying the browser type & version and operating system
• Web site from which our site was accessed
• Name of your Internet service provider

Log File Data is deleted as soon as it is no longer required for the purposes stated below, however, latest 3 months after it is collected. Please note that we anonymize IP addresses out of the Log File Data directly after the session of your request has ended.

We use Log File Data
• to technically improve the website,
• to ensure system security,
• for technical administration of the network infrastructure,
• to prevent and pursue fraudulent access to our network infrastructure.

There is no obligation to provide these Personal Data, however, if you visit our website, these Personal Data will be automatically processed by us.

 

5.  Disclosure to Recipients

Within DOCOMO Euro-Labs, only such persons have access who need it for the purposes set forth under number 4.

We may disclose your Personal Data to governmental bodies or public authorities if this is necessary to comply with applicable mandatory laws or orders or if the disclosure of such data is necessary in order to take legal action in cases of fraudulent access to our network infrastructure or to otherwise defend or pursue our legitimate interests in civil or criminal legal proceedings.

Your Personal Data may also be disclosed to and processed by external service providers which, however, we contractually oblige to process your Personal Data solely under our instructions and on our behalf and to maintain and ensure confidentiality. External service providers will not use your Personal Data for other purposes than those stated in this Website Privacy Policy.

In some cases we may also transfer your personal data to private bodies, such as lawyers, tax consultants, auditors.

Beyond this, we do not sell, lease, rent or otherwise disclose your Personal Data to third parties.

6.  Data Transfer to Third Countries

If data is transferred to bodies outside the European Economic Area, we ensure prior to the transfer that the recipient either has an appropriate data protection level (e.g. by adequacy decision of the European Commission or the agreement of so-called EU standard contractual clauses with the recipient) or you consented into the transfer.

We can provide you with an overview of the recipients in third countries and a copy of the specific guarantees in order to ensure the appropriate level of data protection. In such a case, please contact us via contact points provided under no. 2.

7.  Your Rights in Relation to Your Personal Data

You are entitled to several rights. In detail:

Right of access: You are entitled to receive access to your personal data processed by us.

Right of rectification and erasure: You can request us to rectify inaccurate data and to complete incomplete personal data. Furthermore you can request us – to the extent the statutory requirements are fulfilled – to delete your data.

Restriction of processing: You can request us – to the extent the statutory requirements are fulfilled – to restrict the processing of your data.

Data portability: If you have provided data on the basis of a contract or consent, you have the right to receive the provided data in a structured, commonly used and machine-readable format or that the data is transferred directly to another controller.

Objection against data processing in the event of the legal basis of Article 6 (1) f) GDPR: You are entitled to object to data processing by us for reasons resulting from your particular situation at any time to the extent this is based upon the legal basis of “legitimate interest” (Article 6 (1) f) GDPR). If you exercise your right of objection, we will cease processing your data, unless we can, in accordance with statutory provisions, prove compelling legitimate grounds for the processing which override the interests, rights and freedoms of you or for the establishment, exercise or defence of legal claims.

Withdrawal of consent: If you have given your consent to the processing of your data, you can withdraw it at any time with effect for the future. This does not affect the legitimacy of the processing of your personal data before the withdrawal of the consent.

Complaint with a supervisory authority: In addition, you can lodge a complaint with a  supervisory authority if you are of the opinion that the processing of your data violates applicable law. For this purpose, you can contact in particular the supervisory authority in the member state of your habitual residence, place of work or place of the alleged infringement.

Your contact with us and exercise of your rights: You can contact us free of charge if you have questions on the processing of your personal data, your rights as data subject and any approval granted. In order to exercise all of your abovementioned rights, please contact us via the contact details set forth above under no. 2.

8.  Automated Individual Decision-Making, Including Profiling

We don’t use any automated individual decision-making, including profiling.
